Chi tratta i tuoi dati

I dati li vedono solo le persone della famiglia che gestiscono la casa e le prenotazioni.

Quali dati, perché e su quale base

Prenotazione dal sito. Nome, email, telefono (facoltativo), date, numero di ospiti, appartamento, animali, importo e riferimenti del pagamento, data di accettazione delle condizioni. Servono a gestire la prenotazione e il soggiorno, a mandarti la conferma e a fare eventuali rimborsi. Base giuridica: esecuzione del contratto (art. 6.1.b). Senza questi dati non possiamo accettare la prenotazione.
Pagamento. Lo gestisce Stripe: i dati della carta li inserisci sulla pagina di Stripe e noi non li vediamo mai. Riceviamo solo l'esito, l'importo e un riferimento del pagamento.
Domande e richieste (modulo "Hai una domanda?" ed email a info@cortivo81.com). Nome, email, telefono se lo indichi, testo del messaggio. Servono solo a risponderti. Base giuridica: misure precontrattuali ed esecuzione del contratto (art. 6.1.b).
All'arrivo. La legge ci obbliga a comunicare alla Questura i dati dei documenti d'identità di tutti gli ospiti (art. 109 del Testo unico delle leggi di pubblica sicurezza, servizio Alloggiati Web) e a conservare i dati richiesti dalle norme fiscali. Base giuridica: obbligo di legge (art. 6.1.c).
Recensioni. Nella sezione "Cosa dicono gli ospiti" pubblichiamo recensioni lasciate sui portali di prenotazione, con il nome come lo mostra il portale (nome e iniziale del cognome), il paese e il mese, e pagine del libro degli ospiti che si trova in casa, con i soli nomi di battesimo degli adulti: cognomi e firme li copriamo. Base giuridica: legittimo interesse a far conoscere l'esperienza degli ospiti (art. 6.1.f). Se ti riconosci e vuoi che togliamo una recensione o una pagina, scrivici e la togliamo.
Sicurezza del sito. Cloudflare, che ospita il sito, tratta i dati tecnici delle richieste (indirizzo IP, browser, pagina richiesta) per proteggerlo da abusi, e i registri si cancellano dopo pochi giorni. Per limitare i tentativi di accesso all'area riservata dello staff conserviamo per 15 minuti un'impronta cifrata dell'indirizzo IP, non l'indirizzo. Base giuridica: legittimo interesse alla sicurezza (art. 6.1.f).

Se prenoti tramite Booking.com, Airbnb o Holidu, il portale ci trasmette i dati necessari al soggiorno e resta titolare autonomo del proprio servizio, con la sua informativa. Ai portali trasmettiamo solo le date occupate, senza nomi né altri dati degli ospiti.

Cookie

Il sito non usa cookie di profilazione, pubblicità o statistica e non installa cookie propri, per questo non c'è il banner. Nel tuo browser salviamo solo la lingua che scegli (localStorage): è un'informazione tecnica che resta sul tuo dispositivo.

La mappa della sezione "Dove siamo" carica le immagini dai server di OpenStreetMap (OpenStreetMap Foundation, Regno Unito), che ricevono il tuo indirizzo IP come per qualsiasi risorsa scaricata dal browser. Caratteri e librerie sono ospitati su questo sito: non contattiamo Google Fonts né altri servizi esterni. La pagina di pagamento è di Stripe (checkout.stripe.com) e usa i propri cookie tecnici e antifrode, descritti nell'informativa di Stripe.

Chi riceve i dati

Trattano dati per nostro conto, con contratti ai sensi dell'art. 28 GDPR:

Cloudflare, Inc. (USA): hosting del sito, database delle prenotazioni, instradamento della posta di info@cortivo81.com;
Resend, Inc. (USA): invio delle email di conferma e di servizio;
Google (Gmail) e Italiaonline (Libero Mail): caselle di posta dei gestori, dove arrivano le email e le notifiche delle prenotazioni.

Stripe Payments Europe Ltd (Irlanda) gestisce i pagamenti: per nostro conto nell'incasso e nei rimborsi, e come titolare autonomo per gli obblighi di legge che lo riguardano, come antiriciclaggio e prevenzione delle frodi. Le autorità pubbliche ricevono i dati solo quando lo prevede la legge. Non vendiamo né cediamo dati a nessuno e non li usiamo per pubblicità.

Trasferimenti fuori dall'Unione europea

Cloudflare, Resend, Stripe e Google possono trattare dati anche negli Stati Uniti. Il trasferimento si basa sulla decisione di adeguatezza UE-USA del 10 luglio 2023 (Data Privacy Framework), per le società certificate, e sulle clausole contrattuali standard approvate dalla Commissione europea. Per il Regno Unito (OpenStreetMap) vale la decisione di adeguatezza della Commissione. Puoi chiederci copia delle garanzie a info@cortivo81.com.

Per quanto tempo

Prenotazioni e pagamenti: 10 anni dal soggiorno, per gli obblighi fiscali e la tutela dei diritti; poi nome e recapiti vengono cancellati automaticamente.
Richieste inviate dal modulo del sito: 12 mesi, poi cancellate automaticamente.
Email nelle caselle dei gestori: finché servono a gestire la richiesta o il soggiorno.
Dati dei documenti d'identità: comunicati alla Questura e conservati solo per il tempo previsto dalla legge.
Recensioni: finché restano pubblicate; le togliamo se ce lo chiedi.
Registri tecnici di Cloudflare: pochi giorni.

I tuoi diritti

Puoi chiedere di accedere ai tuoi dati, correggerli, cancellarli, limitarne il trattamento e riceverli in un formato leggibile da un computer (portabilità). Puoi anche opporti ai trattamenti basati sul legittimo interesse, come la pubblicazione di una recensione. Scrivi a info@cortivo81.com: rispondiamo entro un mese, e possiamo chiederti di scrivere dall'indirizzo usato per la prenotazione per verificare che sei tu. Alcuni dati dobbiamo conservarli per legge anche se ne chiedi la cancellazione, per esempio quelli fiscali. Non prendiamo decisioni automatizzate che ti riguardano. Puoi presentare reclamo al Garante per la protezione dei dati personali (garanteprivacy.it) o all'autorità del paese in cui vivi.

Minori

Prenota un adulto, che ci fornisce anche i dati degli ospiti minorenni quando la legge lo richiede, per esempio per la comunicazione alla Questura. Non pubblichiamo nomi di bambini.

Modifiche

Se cambiamo questa informativa aggiorniamo la data in alto. Le modifiche importanti le segnaliamo anche a chi ha una prenotazione in corso.

Who processes your data

The data controller is Sergio Isolabella, who runs the holiday home Il Cortivo 81, Località Fratta 81, 31020 Tarzo (TV), Italy. For any privacy question write to info@cortivo81.com or call +39 353 498 6607. We have not appointed a data protection officer (DPO), as we are not required to. Your data is seen only by the family members who look after the house and the bookings.

What data, why, and on what basis

Bookings on this site. Name, email, phone (optional), dates, number of guests, apartment, pets, amount and payment references, date you accepted the booking conditions. We use them to manage your booking and stay, send the confirmation and make any refunds. Legal basis: performance of the contract (Art. 6(1)(b)). Without them we cannot accept the booking.
Payment. Handled by Stripe: you enter your card details on Stripe's page and we never see them. We only receive the outcome, the amount and a payment reference.
Questions and requests (the "Have a question?" form and emails to info@cortivo81.com). Name, email, phone if you give it, your message. Used only to reply to you. Legal basis: pre-contractual steps and performance of the contract (Art. 6(1)(b)).
On arrival. Italian law requires us to report the identity documents of all guests to the police (Art. 109 of the Consolidated Public Security Act, "Alloggiati Web" service) and to keep the data required by tax rules. Legal basis: legal obligation (Art. 6(1)(c)).
Reviews. In "What our guests say" we publish reviews left on booking sites, with the name as the site shows it (first name and initial), country and month, and pages of the guestbook kept in the house, with adults' first names only: surnames and signatures are hidden. Legal basis: legitimate interest in sharing guests' experiences (Art. 6(1)(f)). If you recognise yourself and want a review or page removed, write to us and we will remove it.
Site security. Cloudflare, which hosts the site, processes technical request data (IP address, browser, page requested) to protect it from abuse; the logs are deleted after a few days. To limit login attempts to the staff area we keep an encrypted fingerprint of the IP address, not the address itself, for 15 minutes. Legal basis: legitimate interest in security (Art. 6(1)(f)).

If you book through Booking.com, Airbnb or Holidu, the site passes us the data needed for your stay and remains an independent controller for its own service, under its own privacy notice. We send those sites only the occupied dates, never names or other guest data.

Cookies

This site uses no profiling, advertising or analytics cookies and sets no cookies of its own, which is why there is no cookie banner. In your browser we store only the language you choose (localStorage): technical information that stays on your device.

The map in "Where we are" loads its images from OpenStreetMap servers (OpenStreetMap Foundation, United Kingdom), which receive your IP address as with any file your browser downloads. Fonts and libraries are hosted on this site: we do not contact Google Fonts or other external services. The payment page belongs to Stripe (checkout.stripe.com) and uses Stripe's own technical and anti-fraud cookies, described in Stripe's privacy notice.

Who receives the data

These providers process data on our behalf under contracts pursuant to Art. 28 GDPR:

Cloudflare, Inc. (USA): website hosting, bookings database, routing of email sent to info@cortivo81.com;
Resend, Inc. (USA): sending confirmation and service emails;
Google (Gmail) and Italiaonline (Libero Mail): the hosts' mailboxes, where emails and booking notifications arrive.

Stripe Payments Europe Ltd (Ireland) handles payments: on our behalf for collections and refunds, and as an independent controller for its own legal obligations such as anti-money-laundering and fraud prevention. Public authorities receive data only where the law requires it. We do not sell or share data with anyone and do not use it for advertising.

Transfers outside the European Union

Cloudflare, Resend, Stripe and Google may also process data in the United States. Such transfers rely on the EU-US adequacy decision of 10 July 2023 (Data Privacy Framework) for certified companies, and on the standard contractual clauses approved by the European Commission. For the United Kingdom (OpenStreetMap) the Commission's adequacy decision applies. You can ask us for a copy of the safeguards at info@cortivo81.com.

How long we keep data

Bookings and payments: 10 years after the stay, for tax obligations and legal claims; then names and contact details are deleted automatically.
Requests sent through the site form: 12 months, then deleted automatically.
Emails in the hosts' mailboxes: as long as needed to handle the request or stay.
Identity document data: reported to the police and kept only as long as the law requires.
Reviews: as long as they are published; we remove them if you ask.
Cloudflare technical logs: a few days.

Your rights

You can ask to access, correct or delete your data, restrict its processing and receive it in a machine-readable format (portability). You can also object to processing based on legitimate interest, such as the publication of a review. Write to info@cortivo81.com: we reply within one month, and we may ask you to write from the address used for the booking to confirm it is you. Some data we must keep by law even if you ask for deletion, for example tax records. We do not make automated decisions about you. You can lodge a complaint with the Italian data protection authority, the Garante per la protezione dei dati personali (garanteprivacy.it), or with the authority of the country where you live.

Children

Bookings are made by an adult, who also gives us the data of guests under 18 where the law requires it, for example for the police report. We do not publish children's names.

Changes

If we change this notice we update the date at the top. We also tell guests with an upcoming stay about important changes.

Welche Daten, wozu und auf welcher Grundlage

Buchungen auf dieser Website. Name, E-Mail, Telefon (freiwillig), Daten, Anzahl der Gäste, Wohnung, Haustiere, Betrag und Zahlungsreferenzen, Datum der Annahme der Buchungsbedingungen. Wir nutzen sie, um Buchung und Aufenthalt abzuwickeln, die Bestätigung zu senden und Erstattungen vorzunehmen. Rechtsgrundlage: Vertragserfüllung (Art. 6 Abs. 1 lit. b). Ohne diese Daten können wir die Buchung nicht annehmen.
Zahlung. Sie erfolgt über Stripe: Ihre Kartendaten geben Sie auf der Seite von Stripe ein, wir sehen sie nie. Wir erhalten nur das Ergebnis, den Betrag und eine Zahlungsreferenz.
Fragen und Anfragen (Formular „Haben Sie eine Frage?“ und E-Mails an info@cortivo81.com). Name, E-Mail, Telefon falls angegeben, Ihre Nachricht. Nur um Ihnen zu antworten. Rechtsgrundlage: vorvertragliche Maßnahmen und Vertragserfüllung (Art. 6 Abs. 1 lit. b).
Bei der Ankunft. Das italienische Recht verpflichtet uns, die Ausweisdaten aller Gäste der Polizei zu melden (Art. 109 des Gesetzes über die öffentliche Sicherheit, Dienst „Alloggiati Web“) und die steuerlich vorgeschriebenen Daten aufzubewahren. Rechtsgrundlage: rechtliche Verpflichtung (Art. 6 Abs. 1 lit. c).
Bewertungen. Unter „Was unsere Gäste sagen“ veröffentlichen wir Bewertungen von Buchungsportalen mit dem Namen, wie das Portal ihn zeigt (Vorname und Initiale), Land und Monat, sowie Seiten aus dem Gästebuch im Haus, nur mit den Vornamen der Erwachsenen: Nachnamen und Unterschriften werden unkenntlich gemacht. Rechtsgrundlage: berechtigtes Interesse, die Erfahrungen der Gäste zu zeigen (Art. 6 Abs. 1 lit. f). Wenn Sie sich wiedererkennen und eine Bewertung oder Seite entfernt haben möchten, schreiben Sie uns, und wir entfernen sie.
Sicherheit der Website. Cloudflare, das die Website hostet, verarbeitet technische Daten der Anfragen (IP-Adresse, Browser, aufgerufene Seite), um sie vor Missbrauch zu schützen; die Protokolle werden nach wenigen Tagen gelöscht. Um Anmeldeversuche im Personalbereich zu begrenzen, speichern wir 15 Minuten lang einen verschlüsselten Fingerabdruck der IP-Adresse, nicht die Adresse selbst. Rechtsgrundlage: berechtigtes Interesse an der Sicherheit (Art. 6 Abs. 1 lit. f).

Wenn Sie über Booking.com, Airbnb oder Holidu buchen, übermittelt uns das Portal die für den Aufenthalt nötigen Daten und bleibt für seinen eigenen Dienst eigenständiger Verantwortlicher mit eigener Datenschutzerklärung. An die Portale übermitteln wir nur die belegten Daten, keine Namen oder sonstigen Gästedaten.

Cookies

Diese Website verwendet keine Profiling-, Werbe- oder Statistik-Cookies und setzt keine eigenen Cookies, deshalb gibt es kein Cookie-Banner. In Ihrem Browser speichern wir nur die gewählte Sprache (localStorage): eine technische Angabe, die auf Ihrem Gerät bleibt.

Resend, Inc. (USA): Versand der Bestätigungs- und Service-E-Mails;
Google (Gmail) und Italiaonline (Libero Mail): Postfächer der Gastgeber, in denen E-Mails und Buchungsbenachrichtigungen ankommen.

Stripe Payments Europe Ltd (Irland) wickelt die Zahlungen ab: in unserem Auftrag bei Zahlung und Erstattung und als eigenständiger Verantwortlicher für die eigenen gesetzlichen Pflichten, etwa Geldwäsche- und Betrugsprävention. Behörden erhalten Daten nur, wenn das Gesetz es vorsieht. Wir verkaufen keine Daten, geben sie nicht weiter und nutzen sie nicht für Werbung.

Übermittlungen außerhalb der Europäischen Union

Cloudflare, Resend, Stripe und Google können Daten auch in den USA verarbeiten. Grundlage ist der Angemessenheitsbeschluss EU-USA vom 10. Juli 2023 (Data Privacy Framework) für zertifizierte Unternehmen sowie die von der Europäischen Kommission genehmigten Standardvertragsklauseln. Für das Vereinigte Königreich (OpenStreetMap) gilt der Angemessenheitsbeschluss der Kommission. Eine Kopie der Garantien erhalten Sie auf Anfrage an info@cortivo81.com.

Speicherdauer

Buchungen und Zahlungen: 10 Jahre nach dem Aufenthalt, wegen steuerlicher Pflichten und zur Rechtsverteidigung; danach werden Name und Kontaktdaten automatisch gelöscht.
Anfragen über das Formular der Website: 12 Monate, dann automatisch gelöscht.
E-Mails in den Postfächern der Gastgeber: solange sie für Anfrage oder Aufenthalt nötig sind.
Ausweisdaten: der Polizei gemeldet und nur so lange aufbewahrt, wie das Gesetz es verlangt.
Bewertungen: solange sie veröffentlicht sind; auf Wunsch entfernen wir sie.
Technische Protokolle von Cloudflare: wenige Tage.

Ihre Rechte

Sie können Auskunft, Berichtigung, Löschung und Einschränkung der Verarbeitung verlangen und Ihre Daten in einem maschinenlesbaren Format erhalten (Datenübertragbarkeit). Sie können außerdem der Verarbeitung auf Grundlage des berechtigten Interesses widersprechen, etwa der Veröffentlichung einer Bewertung. Schreiben Sie an info@cortivo81.com: Wir antworten innerhalb eines Monats und können Sie bitten, von der bei der Buchung verwendeten Adresse zu schreiben, um Ihre Identität zu prüfen. Manche Daten müssen wir auch nach einem Löschantrag gesetzlich aufbewahren, zum Beispiel steuerliche Unterlagen. Wir treffen keine automatisierten Entscheidungen über Sie. Sie können sich bei der italienischen Datenschutzbehörde, dem Garante per la protezione dei dati personali (garanteprivacy.it), oder bei der Behörde Ihres Wohnsitzlandes beschweren.

Minderjährige

Die Buchung nimmt ein Erwachsener vor, der uns auch die Daten minderjähriger Gäste gibt, wenn das Gesetz es verlangt, etwa für die Meldung an die Polizei. Namen von Kindern veröffentlichen wir nicht.

Änderungen

Wenn wir diese Informationen ändern, aktualisieren wir das Datum oben. Über wichtige Änderungen informieren wir auch Gäste mit bevorstehendem Aufenthalt.
